Apparently the employer did not appeal the determination that the employee was not disqualified (although refusal to work a religious day may be protected by statute). However, once there was no disqualification, the issue of eligibility clearly involves STATE action which is in this case violative of the First Amendment.Anonymousnoreply@blogger.com
